TERMS AMD CONDITIONS
All contracts for the purchase of products concluded through the website www.simracecomponents.com between the seller and the customer are governed by these conditions of sale.
The stipulated contract must be considered concluded with the acceptance of the order by SIMRACECOMPONENTS S.N.C., which reserves the right, at its sole discretion, to accept the order. The Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions. Any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order. Delivery times are indicative and not binding. No compensation for direct or indirect damages can be requested for failed or delayed delivery.

- Hidden damage
It may happen to discover a defect only after having removed the packaging. In this case you must provide us with the photographic documentation by e-mail within 24 hours of receipt of the goods. We will send you the defective component free of charge as soon as possible. The replacements will be made to the shipping address (or any address provided in neighboring areas) entered in the order. - Right of withdrawal
The legislation on the sale of products via the internet (articles from 50 to 68 of the Consumer Code) provides the consumer with the right to withdraw from contracts or contractual proposals, guaranteeing him the right to return the purchased product and obtain reimbursement of the expense incurred. The right of withdrawal is reserved exclusively for private consumers who purchase goods for purposes not related to their professional, commercial or entrepreneurial activity. The costs of returning the product are charged to the customer. The right of withdrawal cannot be exercised for all “made-to-measure or clearly personalized goods” (so states the law on the right of withdrawal); most of the products in our electronic catalog fall into this category as they are clearly personalized on precise indications provided by the customer, therefore we ask you to contact us for any further information. To exercise the right of withdrawal it is necessary to communicate to SIMRACECOMPONENTS S.N.C. within 10 working days of receipt of the goods, the will to withdraw from the contract in the following ways: sending a registered letter with acknowledgment of receipt to the address, SIMRACECOMPONENTS SNC, Via dell’asilo 29 – 20851 Lissone (MB). It is also possible to communicate the desire to withdraw to our e-mail address. After the notification of withdrawal, the customer will send the product carefully packed in the original packaging and complete with all accessories at his own expense. SIMRACECOMPONENTS SNC will refund the products within 15 days once the integrity of the same has been checked. The refund is made by bank transfer to the current account number provided by the customer.

SIMRACECOMPONENTS SNC, owner of the www.simracecomponents.com domain, issues and sends a regular invoice by email for each order placed and settled by payment.
- Warranties
Pursuant to Legislative Decree 206/2005 (“Consumer Code”) all products on sale on the site www.simracecomponents.com are covered by the 24-month legal guarantee. For VAT holders, the legal guarantee is not valid, but the commercial guarantee remains valid, which can vary from 12/24 months depending on the company purchased. The legal guarantee provides for liability towards the consumer for lack of conformity that cannot be found at the time of purchase. In the event of a lack of conformity, the consumer has the right to restore, without charge, the conformity of the goods by repair or replacement (Article 130 of the Consumer Code). The consumer can ask the seller to repair the goods or to replace them, free of charge in both cases, unless the requested remedy is objectively impossible or excessively expensive compared to the other. Repairs or replacements must be made within a reasonable period of the request from the consumer. Improved product variations that were not indicated in the “Product description” sheet at the time of purchase are not to be considered “defects of conformity”. Timing and methods of exercising the Legal Guarantee. The Customer must: Send a written communication with photographic documentation to SIMRACECOMPONENTS SNC indicating the defect of the product; SIMRACECOMPONENTS SNC, as soon as the product defect has been ascertained, will proceed to activate the procedure for the reintegration of the defective product or component. The company excludes any guarantee where it is found that the defect derives from the customer’s fault, negligence, inexperience or imprudence. The Company will not be liable if the faults, defects or failures have been caused by the incorrect behavior of the customer; the guarantee is not valid even when the product is damaged due to the use of unsuitable products or incorrect installation.
- Unavailability of ordered products
If an order is received for a product that has been discontinued and/or is no longer available, SIMRACECOMPONENTS SNC will send notice of cancellation as soon as possible and refund the payment made. The customer cannot request any penalty as compensation.

Although the products are easy to assemble, their assembly may be difficult for people with little dexterity, therefore we suggest that you read the advice on the assembly page.
